These Terms of Service ("Terms") govern your access to and use of the ALOURA Fine Jewellery website, online store, and all related products, services, and communications (collectively, the "Services"). Please read these Terms carefully before placing an order or using our website.

ALOURA makes reasonable efforts to ensure that all product descriptions, images, specifications, and pricing are accurate at the time of publication. However, we do not warrant that product descriptions or other content on this website are complete, accurate, reliable, or error-free.

Product images are for illustrative and representational purposes only. Actual product appearance, colour, dimensions, and finish may vary slightly due to photography conditions, screen display settings, or minor manufacturing variances. These variances do not constitute a defect or grounds for return outside of our standard Return Policy.

4.2 Third-Party Product Images

Certain product images displayed on this website may have been sourced from third-party websites, public platforms, or general internet sources and are used solely for the purpose of representing the nature, style, and approximate appearance of products offered by ALOURA.

4.3 Pricing

All prices are displayed in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change at any time without prior notice. The price charged for a product will be the price displayed at the time your order is placed, subject to verification.

ALOURA reserves the right to cancel any order placed at an erroneous price resulting from a typographical error, pricing system error, or any other inaccuracy, and will notify you promptly if this occurs.

4.4 Taxes & Duties

Applicable taxes will be calculated and displayed at checkout based on your shipping address. For international orders, you are solely responsible for any import duties, customs fees, or taxes imposed by your country's customs authority. ALOURA is not responsible for delays or additional costs resulting from customs processing.

5. Orders & Payment

5.1 Order Placement

By placing an order, you are making a binding offer to purchase the selected product(s) at the stated price and agree to these Terms. Your order constitutes an offer to ALOURA, not a confirmed sale.

5.2 Order Confirmation

Upon placing your order, you will receive an automated confirmation email. This email confirms receipt of your order — it does not constitute acceptance. ALOURA reserves the right to accept, modify, or cancel any order after confirmation.

5.3 Order Acceptance

A binding contract between you and ALOURA is formed when your order has been processed, payment has been verified, and your item has been dispatched. ALOURA reserves the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability or discontinuation.
  • Errors in pricing or product information.
  • Suspected fraudulent activity.
  • Failure of payment authorization.

5.4 Payment

We accept all major credit and debit cards, Shop Pay, Apple Pay, Google Pay, and other payment methods displayed at checkout. All transactions are processed through secure, encrypted payment gateways. ALOURA does not store your full payment card details.

By submitting payment, you represent and warrant that you are authorized to use the payment method provided and that the billing information you have submitted is accurate.

5.5 Buy Now, Pay Later

ALOURA may offer instalment payment options through third-party providers (such as Afterpay, Klarna, or Shop Pay Instalments). Use of these services is subject to the terms and conditions of the respective third-party provider. ALOURA is not responsible for any fees, charges, or disputes arising from your use of third-party payment services.

6. Shipping & Delivery

6.1 Processing Time

Orders are typically processed within 1–3 business days of confirmed payment, excluding weekends and public holidays.

6.2 Shipping Times

Estimated delivery times vary by destination and shipping method selected at checkout. Estimated shipping times are provided by our carrier partners and are not guaranteed. ALOURA is not responsible for delays caused by carriers, customs processing, weather, or other circumstances outside our control.

6.3 Shipping Costs

Shipping costs are calculated and displayed at checkout based on your shipping address and selected method. Free shipping thresholds, if applicable, will be displayed on the website and are subject to change.

6.4 Risk of Loss

All risk of loss or damage to products passes to you upon delivery to the shipping carrier. Once your order has been dispatched and a tracking number provided, ALOURA's responsibility for the physical product transfers to the carrier.

6.5 Shipping Protection

ALOURA may offer optional shipping protection at checkout through a third-party provider. This coverage is subject to the terms of that provider. ALOURA is not responsible for packages lost, stolen, or damaged in transit where shipping protection was not selected.

6.6 Address Accuracy

You are solely responsible for providing an accurate and complete shipping address at the time of order. ALOURA is not liable for failed deliveries, lost packages, or additional shipping costs resulting from an incorrect or incomplete address.

7. Returns, Refunds & Exchanges

7.1 Return Window

ALOURA accepts returns on eligible items within 14 days of confirmed delivery, provided the item is:

  • In its original, unworn condition.
  • Free from damage, alterations, or signs of use.
  • In its original packaging with all included accessories and documentation.

7.2 Non-Returnable Items

The following items are final sale and not eligible for return or exchange:

  • Custom, engraved, or personalized items.
  • Earrings (for hygiene reasons), unless received damaged or defective.
  • Items marked as final sale at the time of purchase.
  • Grillz or any product that has been custom-fitted or altered.

7.3 Defective or Incorrect Items

If you receive a defective, damaged, or incorrect item, please contact us within 48 hours of delivery at alourainquiries@gmail.com with your order number and photographs of the issue. We will arrange a replacement, repair, or full refund at our discretion.

7.4 Return Process

To initiate a return, contact alourainquiries@gmail.com with your order number and reason for return. Do not ship items back without prior authorization from ALOURA. Unauthorized returns may not be accepted or refunded.

7.5 Refunds

Approved refunds will be processed to your original payment method within 5–10 business days of our receipt and inspection of the returned item. Original shipping costs are non-refundable unless the return is due to our error.

7.6 Return Shipping

Return shipping costs are the responsibility of the customer unless the return is due to a defect, damage, or error on our part. We recommend using a tracked shipping method for returns, as ALOURA is not responsible for items lost in return transit.

8. Warranty

ALOURA stands behind the quality of every piece we sell. All ALOURA products are covered by a lifetime craftsmanship warranty against manufacturing defects, including:

  • Stone loss under normal wear conditions.
  • Clasp or closure failure under normal use.
  • Plating defects present at the time of delivery.

This warranty does not cover:

  • Damage resulting from misuse, accidents, improper care, or neglect.
  • Normal wear and tarnishing over time.
  • Damage caused by exposure to chemicals, perfumes, water, or extreme conditions.
  • Modifications or repairs made by a third party.

To make a warranty claim, contact alourainquiries@gmail.com with your order number and photographs of the defect. ALOURA will assess all warranty claims at its sole discretion and may offer repair, replacement, or store credit.

9. Intellectual Property

9.1 ALOURA Original Content

All original content created by or for ALOURA — including written copy, product descriptions, branding, logos, graphics, marketing materials, website design, and trade dress — is the exclusive intellectual property of ALOURA Fine Jewellery and is protected under applicable copyright, trademark, and intellectual property laws.

No ALOURA original content may be reproduced, copied, distributed, modified, or used in any form without prior written consent from ALOURA.

9.2 Third-Party Images

As described in Section 4.2, certain images on this website may be sourced from third-party platforms. ALOURA does not claim ownership of such images. If you believe your copyrighted image appears on this website without authorization, please contact alourainquiries@gmail.com for prompt resolution.

9.3 Trademarks

18. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and applicable federal Canadian laws, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this website shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration or resolved in the courts of competent jurisdiction in Ontario, Canada.

By using this website, you irrevocably consent to the exclusive jurisdiction of the courts of Ontario, Canada for the resolution of any disputes not subject to arbitration.
